Local Values and Judges’ Legal Discretion in Islamic Court of Makassar: the Case of “Dispensasi Nikah”

Abstract


Abstract: This paper examines the legal considerations of judges who focus on marriage dispensation cases in the Makassar Religious Court by linking local wisdom that focuses on early marriage that is often carried out by the Makassar community. This paper examines and observes the attitudes and legal considerations of judges associated with the customary law of underage marriages that occur in Makassar. The focus of the first discussion, Does the customary understanding of underage marriages affect judges' legal considerations in giving judicial legal considerations in marital dispensation cases? Second, why do judges behave this way? The primary source of this paper is obtained from a copy of the marriage dispensation decision accessed through the RI Supreme Court Directory. The decision on marriage disbursement was strengthened by the opinion of the judge. Supported by sources in the form of books, papers, and interviews related to the dispensation of marriage and underage marriage that occurred in Makassar. The author finds that the understanding of adat (underage marriage) in Makassar influences judges' legal considerations, where the majority of judges' legal considerations include adat as an amplifier of judges' legal considerations which they decide. There are two fundamental reasons related to the influence of adat on a judge's decision, namely that the judge is obliged to explore the cultural values contained in the community where he was assigned, also, Qaidah Fiqhiyyah categorizes that customary law can be used as law. Legal pluralism between state law and traditional law colors various types of law in Indonesia. State law still acts as the main agent, so customary law should not conflict with state law. Also, judges should explore customary law to strengthen something positive in society.
